Terms and conditions   Terms & Conditions Conditions of sale 1. You confirm that you are aged over 18 years old and are legally able to purchase prescription spectacles from lowcostspex. 2. You confirm that you are not registered blind or partially sighted 3. You agree to provide any details reasonably requested by lowcostspex to confirm that you are legally able to purchase prescription spectacles. 4. You agree to make purchases on the lowcostspex website using your correct name, address, date of birth and any other details requested. 5. Your prescription has been issued in the last 2 years 6. We shall not be liable for any errors made by you when entering prescription details online. 7.A description of the goods is set out on our website. Whilst we will attempt to ensure that there are no changes to the goods to be supplied, it is possible that there may be some minor variations to the description and/or specification of the goods that arise by virtue of changes made by the manufacturers of the parts supplied which form part of the goods. 8.For contracts made between us without face to face contact, you will have 7 days to cancel any order placed under this contract. This right does not apply at any time after we have started the manufacturing process to customise goods for yourself. Availability of goods 1. All goods advertised for sale on the site are subject to availability. If an item that you wish to order is unavailable, we shall inform you by email or phone. The reason for unavailability is usually because we are awaiting deliveries from our suppliers. 2. We shall not charge you for goods that we cannot supply for any reason.. 3. We have attempted to display all the goods on the site as accurately and fairly as possible, taking account of the available reproduction techniques that apply to website design, graphical and photographic technology. Force Majeure We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes). Limitations of supply 1.Unless specially agreed, we will only supply spectacles with lenses of a spherical power between +8.00 and -8.00 dioptres and a cylindrical power between +4.00 and –4.00 dioptres, with a maximum combined power of 8.00 dioptres. 2.If PD measurements are not supplied, we will set optical centres based on average distance PD's of 65mm for men and 62 mm for women. 3.Bifocal segments will be set 3mm below the horizontal centre line of the lens. Pricing 1. Prices displayed on our site are correct at the time of display. We reserve the right to alter prices from time to time without notice. However, once we have accepted your order, we will not change the price that applies to such order. 2. We make every effort to maintain prices but prices may occasionally move up or down depending upon changes in raw material or other processing costs. 3. All prices displayed are inclusive of United Kingdom VAT at the prevailing standard rate. UK VAT is charged on all sales to customers located within the UK or within another Member State of the European Community (EC). Postage and packaging 1.Delivery to UK addresses only. 2. Postage and packaging is from £3.99 in the UK, however this may be subject to change without notice. We use Royal Mail, and send your orders using 1st class post. For Designer products, postage is using Royal Mail 1st class recorded delivery (signed for). 3.Any other service you request may be charged differently. Payment information 1. We accept payment by Visa, Mastercard, Switch, Solo, Maestro or any other credit card identified on our site that may be accepted by us from time to time. 2. All credit and charge card payments are subject to validation and authorisation by the card issuer. If your card issuer refuses to authorise payment, we will not be liable for any non-delivery or delay. 3. You may pay for your goods by sterling cheque drawn on a UK clearing bank. However, we will not despatch your goods until the cheque has cleared. 4. Transmission of your debit or credit card number or other data in relation to payment for the goods shall be at your entire risk. We cannot accept any responsibility or liability for failures in transmission of information, deletion, non-delivery or failure to store any communications by you. 6. Credit card payment is by SSL 28 bit encryption. 7.Payment is required in full including carriage at the time of placing the order. Despatch of goods 1. We will deliver the goods to the address given to us by you at the time you make your purchase. 2. We endeavour to ensure that the goods are delivered to the address specified by you within 14 days. However, we cannot guarantee that goods will be delivered by the estimated delivery date. You agree that we shall not be liable to you for any losses, damages or charges incurred by you because of late delivery of the goods. 3. You must notify us immediately if you have not received your goods within 14 days. 4. When you have received the goods at the address specified in your delivery instructions, the risk of damage to the goods shall pass to you. Returning goods 1. We want you to be totally satisfied with the goods you buy from our site. If you are not happy with the goods you have purchased, you may return them within 7 days to us for adjustment, replacement(once) or refund of frame only. Refund is in full for the frames providing they are in original condition and complete with case and cloth (excluding p&p). Lenses are bespoke items and therefore we are unable to refund the cost of lenses. Where possible and where appropriate we will exchange for an alternative lens type. This may incur an additional payment if the replacement is a more expensive option.  Plus, every pair of glasses, lenses and coatings are supplied with a 12 Month manufacturers guarantee so that should any of them develop a fault we will repair or replace to the original details specified. 2. Please telephone us on 01438 743384 or email us on info@lowcostspex.co.uk to advise that you wish to return the goods and follow the instructions given. This will usually involve you posting the goods back to us using 1st class recorded mail. 3. The risk of damage to any goods you return to us will remain with you until the goods have been delivered to our premises and accepted by us at those premises. Liability 1. Goods purchased from our site are subject to English Law. 2. Nothing in these terms and conditions is to be taken to exclude or restrict any rights which applicable law grants to you in respect of such goods. Individual goods may be the subject of additional warranties or guarantees given by their manufacturers directly to you. 3. We do not accept any liability for any ordering errors made by you when submitting your order. Please ensure all details are correct before submitting your order. 4. We do not accept any responsibility and will not be liable for any damage to the goods caused by you. 5. We shall not be liable to any person for any damage or loss that may arise from the use of any goods advertised on our site. 6. Without prejudice to your statutory rights, all the information and materials contained in this site (including, without limitation, text, graphics and links) are provided on an "as is" basis with no warranty and in particular, we do not represent or warrant that the information accessible via this site is accurate, complete or current or that the use of this site will be uninterrupted or error-free. 7. Notwithstanding anything else in these terms and conditions, in relation to any one event or series of events relating to the purchase of any goods from the lowcostspex site, we will not be liable for: (i) claims relating to the availability of the lowcostspex range, the lowcostspex e-commerce engine, the lowcostspex websites, points of purchase, or the success or level of sales resulting there from; (ii) any indirect, incidental or consequential damages or lost profits. 8. The above exclusions of liability shall not apply to any damages arising from personal injury or death where they result from our negligence or the negligence of our servants and agents in the course of their duty. General 1. Notices served under these terms and conditions shall be in writing and will be deemed given when: (1) personally delivered; or (2) when sent by confirmed fax; or (3) three days after being sent by registered mail to the address set out in our despatch note, or to any other later address in the United Kingdom notified for that purpose. 2. Any failure by us to enforce any of these terms and conditions shall not affect our right to enforce the rest of these terms and conditions. 3. These terms and conditions are subject to change at any time without prior notice to you. 4. These terms and conditions shall be governed by and construed in accordance with English Law. Free Pair If we fail to dispatch within 10 Working Days On average we generally dispatch all glasses within 3 working days. Sometimes (normally when we are chasing suppliers) it can take a little longer. But whatever the reason if we fail to dispatch you glasses within 10 working days of receiving your fully completed order we will supply you, at our cost with a pair of single lens glasses from our standard range. When ordering varifocals, the fully completed order is when we have all centration details for fulfilling the order.
